Terms & Conditions

1. Acceptance and scope

These Website Terms of Use (the “Terms”) govern your access to and use of www.accuhairate.com, www.accuhairate-app.com and related public webpages operated by Accuhairate LLC (“AccuHaiRate,” “we,” “us,” or “our”) (the “Website”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

These Terms apply only to ordinary use of the public Website. Separate terms govern the AccuHaiRate consumer App and Provider Portal. For example, if a Provider or organization has a signed service agreement with AccuHaiRate, that signed agreement controls any conflicting term about that service; these Website Terms continue to govern ordinary public Website use.

2. Information only; no medical advice

The Website describes a technology service for organizing and comparing hair-related photographs and for sharing selected information with healthcare professionals. Website content is provided for general informational purposes only. It is not medical advice, diagnosis, treatment, or a substitute for an examination or advice from a qualified healthcare professional.

Use of the Website does not create a physician-patient or other clinical relationship with AccuHaiRate, its personnel, or any healthcare professional mentioned on the Website. AccuHaiRate does not monitor the Website for urgent health concerns. For a medical emergency, call 911 or your local emergency number.

3. No guarantee of results

Descriptions of features, intended uses, potential benefits, or examples are illustrative and do not guarantee that the service will detect a change, improve an outcome, or produce a particular result. Hair appearance and photographic comparisons can be affected by lighting, camera angle, distance, hair position, hair length, styling, moisture, device characteristics, and other factors.

4. Permitted use

Subject to these Terms, AccuHaiRate grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for lawful, personal, and informational purposes.

You may not:

  • copy, reproduce, modify, distribute, sell, sublicense, publicly display, or commercially exploit Website content except as permitted by law or with our written permission;
  • use automated means to scrape, index, probe, or extract Website content except for ordinary search-engine indexing that follows our published instructions;
  • attempt to bypass security controls, introduce malicious code, disrupt the Website, or gain unauthorized access to systems or data;
  • misrepresent your identity or affiliation, infringe another person’s rights, or use the Website for unlawful, fraudulent, or abusive activity; or
  • use our names, logos, or other brand elements in a way that suggests sponsorship or endorsement without written permission.

5. Intellectual property

The Website and its text, graphics, logos, designs, software, and other content are owned by AccuHaiRate or its licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.

If you voluntarily submit feedback or suggestions, you grant AccuHaiRate a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, provided that this does not authorize us to use personal information contrary to our Privacy Policy.

6. Communications and submissions

Do not submit photographs, symptoms, medical records, or other sensitive health information through a general Website contact form or ordinary email. Information submitted through the Website will not be monitored in real time.

7. Third-party services and links

The Website may link to or use services operated by third parties. Those services are governed by their own terms and privacy practices. A link does not imply endorsement, and AccuHaiRate is not responsible for third-party content or services.

8. Privacy and cookies

Our collection and use of personal information through the Website are described in the AccuHaiRate Privacy Policy and Consumer Health Data Notice. The Website may use necessary and analytics technologies as described there and in any cookie controls displayed on the Website.

9. Website availability and changes

We may change, suspend, restrict, or discontinue any part of the Website at any time. We do not promise that the Website will always be available, complete, current, secure, or error-free.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ACCUHAIRATE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCUHAIRATE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE WEBSITE.

To the maximum extent permitted by law, AccuHaiRate’s total liability arising from or related to the Website will not exceed one hundred U.S. dollars (US $100). This limitation does not apply to liability that cannot lawfully be limited or excluded.

12. Governing law and venue

These Terms are governed by New York law, without regard to conflict-of-law rules. Any dispute that is not subject to a separate written dispute-resolution agreement must be brought in the state or federal courts located in New York County, New York, and each party consents to their jurisdiction. This section does not deprive a consumer of nonwaivable protections of the law of the consumer’s residence.

13. Changes to these Terms

We may update these Terms by posting a revised version and changing the effective date. If a change is material, we will provide additional notice when required by law. Your continued use after the revised Terms take effect constitutes acceptance to the extent permitted by law.

14. General

If a provision of these Terms is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
